You say the chp didn't have a reason to pull you over, you were speeding, that's the reason, while driving on public roads a LEO doesn't need a reason to pull you over, they need a reason to detain you.
 
Doesn't an officer need reasonable suspicion to initiate a traffic stop? (Though, this could be pretty much anything....) In this case, the officer could have suspected speeding; that's fine.... But they're not supposed to be allowed to just stop someone because they feel like it....

In any case, being pulled over is being detained. Probable cause is needed for an arrest.

They in fact do need a reason to pull you over, or at least that's what a cop told me one time. Have you ever had a cop tailgating you really hard? That's because they're trying to make you nervous enough that you accidentally violate a traffic law such as going over the speed limit, or crossing over the line.
 
I've had them tailgate me really hard (doing the speed limit) when all they wanted was just to get by and speed themselves. Even had one once flash his lights at me. I pulled over, he turned off his lights and went by pedal down. Hell, the donuts were getting cold.

OK I reached my limit with California.
- I can't afford to live here anymore. between the excessively high priced rent, insurance, goods, gas (3.50 per gallon), & taxes (9.75%).
- The completely lack of jobs (yes I know this isn't unique to my area) with a near 22% unemployment rate.
- When I have to decide between having a car and a place to live. But needing the car to get the place to live and keep a job.

and the two kickers (this is what made me reach my limit)
- My ex-girlfriend goes off meds. breaks into my parents house and destroys it (broke mirrors, appliances, TVs and more) she caused over $20k worth of damage and the courts wont grant me a restraining order against her because it wasn't my house and I didn't live there. (that was this morning)
- then this afternoon I'm on the freeway and get a speeding ticket by the CHP for going 67 in a 65 then not even 5 miles down the rode I get another ticket not for speeding (even though I was going 70 at the time because I was ******) but for having no front license plate. the two tickets are easily 750 dollars, plus the increase to my insurance which is ungodly high because I live in LA County.

So now that I've reached my limit with this area I'm trying to decide where I can move to (preferably somewhere on the opposite side of the country). The only thing I'm really looking for is someplace that I'm not going to have to shovel snow 9 months of the year.

Now I'm going to try to survive the weekend without going postal.

You got a ticket going 67 in a 65? I've never heard of anyone getting a ticket for 2 miles over the limit.

Typically this happens when they are on a silent call. Not all emergencies constitue running code (lightes and siren) to include domestic disputes.

If you see a cop coming fast, try to think that he is probably trying to get somewhere to help/save/defend someone.

They need reasonable suspicion to initiate a traffic stop, but being that no one drivers perfect, they can pull you over for just about anything. I was with him when he initiated a traffic stop because the driver ran over a reflector on the road.

Being pulled over is not being detained. If you feel you are being detained ask the officer "Am I free to go?" if he says "Yes" go on your way, if he says "No" then ask him "Am I being detained?" If he answers "No" then ask again "Am I free to go?" if he says "Yes" then ask "What am I being detained for?"

Yep, that's what I said, reasonable suspicion can be pretty much anything.

If he answers "No" then ask again "Am I free to go?" if he says "Yes" then ask "What am I being detained for?"

Actually I wasn't but the ticket is a non-issue as I already have all my evidents for my part, and I know that I was not paced, nor was my speed verified with radar or laser, the officer approximated my speed as compared to his, and with recent documation that verifies my speedometer was correct and my MoparGPS tracking history for the time of the ticket I have no doubt the judge will toss the ticket out.

So Saturday I go out to get my mail and have a woman sitting in a car about 50 yards from my house, I couldnt make her out by I believe it was my ex as my neighbor is out of town for 3 weeks and I'm watching his house for him, and the house passed that is a waiting funding to finish construction and I'm on a cul-de-sac so no traffic. I think shes found me and now I have to file for a TRO all over again. :(

I think you need to talk to a police officer and lawyer about what "detained" is. For police and lawyers, being detained is being in custody or in confinement. I think you're being confused on what the definition of detainment is from a dictionary. This is why you asked "Am I free to go?" and "Am I being detained?", if he says no, his action was Contact. There are three different types of interactions with police officers: Contact; Detention and Arrest. In Contact, a police is merely trying to figure out whats going on, and see what your up to. You know when this contact when the officer is asking questions such as "Why are in you this area?", "Where are you headed to (or from)?" and "Do you know why I pulled you over?" Another give away is the officer ASKS to search your car or vehicle, if you were being detained the officer wouldn't need to ask your permission as detention is a temporary denial of your civil liberties.

I wouldn't count your chickens before they hatch. GPS is not a reliable source of information as information is approximate, not a for-sure thing. In some cases they have been admissible based on how often the GPS recorded information of direction change and speed. Also, what type of documentation shows your speedometer is correct? Do you have bigger or smaller tires and rims on your vehicle?

Also most officers have to certified in estimating speed, new officers can get it to within 7MPH, an experienced officer can be as accurate as 1MPH. (Local police require officers to be within 4MPH before they can be certified.)

On a side note, when you get to court and if the officer used radar or lidar in addition to his findings on your speed, ask when the unit was last calibrated (According to California law from what I've been told, each unit needs to be calibrated before an officer goes on shift.) also ask when his speedometer was last calibrated and certified. Also ask when he had a refresher course on approximating speed, to absolutely win this, you're going to have to prove that the officer has doubt that the speed he listed is the actual speed you were going.

It's not merely contact when being pulled over.... You do not have the choice of not pulling over. You do not have the choice to just leave. You are at the command of the officer.... It is not reasonable to think that you are free to go.

There are so many circumstances that can affect the definition of arrest, though. But when you're in court, as a defendant or an officer, it's best to be clear on everything, or your case can get screwed.

am i the only person amazed by the fact that a ticket for improper equipment and a ticket for 2 over is 750 dollars? thats insane. 175 TOPS around here for those two combined (improper equip is a non-moving violation so its cheaper and no insurance hit)

The state of California is going for blood, so be extra careful in driving, You cannot afford messing with them. I have been hearing that Highway Patrols are under pressure to issue a lot more tickets than last year with at least 30% increase in fines over 2009, so beware of radar guns, highway and traffic cameras installed everywhere and the tougher enforcement of parking rules.
Just for your info, the next time you park in the handicapped zone, even for a minute, you will be looking at almost $ 1000 in parking tickets , so it'd better be worth it.

I wouldn't call it bickering or arguing, just a friendly conversation, as far as I know :confused:

Your really not having a friendly conversation, I posted something and you insinuate I was breaking the law and proceeded to hijack my post because you assume you know anything and everything about traffic law.

I never asked nor cared anything about what to do in regards of the speeding ticket. The only point of my post was being fed up with how people behave here and I hate to say it your making my point.
