Get a call from a woman that I go to church with. I've been to there company ONCE to do work so I don't have a strong relationship either way.

She is firing someone and needs for me to remove files off the persons PERSONAL computer. I told her that I couldn't do that without his permission. She then explains that the person being fired is her HUSBAND with whom she has separated and filled for a divorce.

Not gonna touch that legal nightmare with a 10 ft pole. :eek:

God I need a drink.
 
Not sure what the law is in your state but in my state if she is still married to the husband, the computer is her property as well and she has every right to get whatever she wants done to it. I wouldn't have a problem fulfilling the request.

Don't know what Texas law is regarding it. And don't want to be caught in a divorce case if they tried to challenge it. She is trying to fire the husband from the family business. I think I'd have a good chance of being sued. Also I go to church with these people. Already just her asking this of me has put me in an awkward situation the next time I run into her at church. Kill me now.

yeah - if I went to church with them or was friends with the husband I would politely decline
 
Something like that needs to be handled by the divorce attorney in terms of procuring the service. But beyond that I agree. Would not touch it with anyone's 10' pole.

I've had a few calls over years in similar situations. "Can you check my husbands computer" "Can you see what text messages he deleted?" "I think my ex husband is getting our son to do things on the computer to spy on me" No thanks.

I might maybe get into it if they came in with a court order ... even then I'd have a hard time swallowing.

The last thing I need is someone bad mouthing me because I found his secret lover's chat or something

I could live with the bad mouthing thing. But with the way people are these days I'd be more worried about a baseball bat or Molotov cocktail.
 
Personally I wouldn't take the case. Years ago I was approached about doing the same thing with a co-worker. She wanted to know if her husband was cheating and needed proof. She offered a good amount but I didn't want to be a part of a broken home if I was to find something. I politely declined.
 
Whether you brought it to us or called us out to your business if you asked us to clean off a computer we would. If we were aware of a sticky situation we might make a backup of the data removed and hold it for 90 days at the shop but in either case we would comply with the management or the person in physical control of the computer.

We frequently have wives bring in a computer and ask us to tell them what was in the cash or history of sites (porn). Our view is if you have have it in your hands it is your computer and you are rightful owner to any information on that computer.

untill one of 3 outcomes happen

number 1 it is found in court that the computer was paid for by him and is his personal computer and he sues you

number 2 he owns the buisness and the computer is buisness property and he sues
just because she says shes firing him dosent mean shes actually in charge she might think she runs the buisness but his names could be on the papers

number 3 if they are married and have joint ownership of the laptop then he has a say in whats done to it

just walk away is the few bucks youll charge for cleaning files off a laptop for some distant aquantence youve not really had any encounter with really worth the lawsuit

I done work like this before and I will always take a image of the system so if the **** hits the fan than you can simply put the image back on the computer at the request of the Almighty! or he can simply get is data back from the NSA.

Just go ahead and do the job get yourself some money and don't stress. What's the worst thing that could happen, the story makes worldwide headline and they make a movie out of it. Matt Daemon plays your part, Micheal Douglas plays the bad husband and the woman his played by Jessica Biel, the movie wins and academy award and you end up being interviewed by leo laporte on Triangulation.

Sorry I got a bit carried away.
