Windows 7 with manufactors name on it

I don't know about any other website but THAT one looks like a scam. Check out their other products, I doubt they do a lot of business.

this is a scam you can not sell dell oem with a new dell. stay far way from this one. Just because people sell it does not make it legal

This is not legit..... or at the very least the usage they describe is not legit.

It's all XP disks anyway ... but I don't understand how they have "legit" COA for XP and ship with an "unlocked" dell OEM disk.

Avoid this. It'll lead to trouble.

100% illegal. Cut and Dry.

The COA is not legal, it's an OEM COA that was mean to be used by Dell when they build new machines. It's not transferable to an existing machine and even in the event you are building new machines I'm not sure using a Dell branded OEM disk/COA is still even legal. They were sold under an agreement to Dell, and I'm pretty sure Microsoft would be against Dell (or anyone else) reselling those disks/liscenses as that (as far as I'm aware) was never a part of the agreement.

Save yourself the headache and stay far far away.

It is a violation of Dell's contract with Microsoft.

You are NOT Dell Inc. There for you cannot resell software that is intended to be installed on Dell PC.

THE ONLY way that companies can get a hold of this is buy purchasing old PCs (or theft of same) and removing the sticker from that PC which is a violation of the OEM license. The fact that the software activates is irrelevant. It is OEM software that was previously been sold and therefore tied to the machine it originally sold with.

Dell does not sell unused copies of it's software. That too is a violation of the Royality OEM agreement.

Do you have anything in writing? or are you just supposing how you think it is?

Q. Can my customers transfer or sell their OEM software licenses?
A. After an OEM software license has been installed on a PC, the license may not be installed on or transferred to another PC. However, the entire PC may be transferred to another end user along with the software license rights. When transferring the PC to the new end user, the software media, manuals (if applicable), and Certificate of Authenticity label must be included. It is also advisable to include the original purchase invoice or receipt. The original end user cannot keep any copies of the software.

Now can you show me ANYWHERE were DELL sells NEW copies of OEM versions of Windows? If Dell sells it then I can buy it. Otherwise the only source of such copies of Windows is from removing them from USED machines. And that is illegal.

Do you have anything in writing?

Dell is large enough to have some say in their contract.

Agree 100%.

If Dell sold these, it would be right on their home page. With everyone losing their minds over windows 8, dell would be selling tons of these (if it were legal) right off of their own website. And they'd be getting more then $45 for it as well.

The fact that this is OEM software means that you need to be building a computer to use with it.

The other major catch, is that these were sold and branded to Dell. For Dell to use on Dell machines. I very highly doubt that this is legal at all.

Microsofts piracy center could probably clear it up pretty quickly. I highly doubt this is legal, even for users buying these to put on new machines that they built and that's only in the case that these were unused and allowed to be resold from Dell, HP or ect.

This put your money were you mouth is. Buy me a copy of Windows 7 DELL branded OEM directly from Dell. If you can get a copy and show me the paper work then I'll eat my words and I will buy it from it from you.

If it is legal to buy it then the source of the LEGAL copy must exist out there somewhere.

You and I both know that it doesn't exist.

Every 6 months they have a big electronics super sale at the fairgrounds. They have lots of old laptops from all the major players, Dell, HP, etc. All of them have Windows on them and none of them have COA stickers on them. You can see the dark shape where they use to be and obviously been removed. If you think you are getting legitimate copies of Windows then I have tickets to a boat trip on the river Nile for you.

BTW is says right on the media "For Distribution Only With a New Dell PC."

That is in writing.

No matter how big you are, an OEM licence is an OEM licence. They are specifically given a discount because of how that contract works.

That is specifically why you and I cannot just peel a sticker off of a dell computer and slap it on another one.

That is also why the refurbisher program is setup the way it is.

One of the fun things about a forum like this is when you start talking legal advice from people who you really know have no idea what the law is or what any legal contract is but that does not stop them from trying to force-ably push their opinions.

I'm not saying you are wrong, although I am confident you are, but that is not the point the point is we do not have the means to make a determination.

You could always call 1-800-RU-LEGIT, and tell them you have Dell COA's and you're selling them on....

That would be fun :D

Funny but do you think their job is to be fair and balanced? Yeah, like fox news.

Bmem has been around for at least a dozen years selling grey market OS's. We bought Win2000 lics from them back when. Software alliances has investigators scour the internet, ebay, craigslist for systems and software and they are very aggressive at shutting down offenders. So why do you suppose they let this one get by them?

They are on pricewatch and have been as long as I have known about pricewatch. Their site clearly says it can be used on other equipment. all an investigator need to do is buy it and then close them down.

I can't speak to the legality of the contract between Dell and MS. Comon sense says it's not legal based on what is printed on the disc. However I don't see why the disc couldn't be just another OEM copy of Windows with Dell's label on it. It which case why couldn't it be resold?
