When sorting a range (NOT a table) in Excel, is there any way to STOP Excel randomly checking the "My data has headers" box?

I swear, when I WANT it, the default is to NOT check the box, and most times, when I definitely DON'T want it,
the default is to check the box. No matter what I'm doing I have the click the damned box to either turn it on or turn it off.
If I had one wish for Office in general, it would be to have a big configuration switch somewhere, like this:
