PC store stealing our business

I would be consulting with a lawyer about this one.

Seems to me that there must be some law against what they are doing, and if they aren't in the mood to stop a nice cease and desist will probably put them in their place very quickly.

This happens quite often, one of my competitors moved out and another computer store moved right in to their old location and told people that they had went out of business. I talked to the guy that moved and he has found no legal avenue to help.

Since opening my current location in 2008 four more stores opened within a couple miles of mine. It seems that lots of people are jumping on the computer store band wagon. We just keep up the advertising and focus on quality. One of them already tanked.

On a funny note, one of my clients had a barber shop in a strip mall and another hair shop opened up in the adjacent unit. He was angry with the landlord for allowing it but the landlord didn't care. They put a big sign up that said $8 hair cuts, he put up a sign "WE FIX $8 Hair Cuts"

I would take it up with the mall management, too. I'm more surprised that they were able to open up shop at all as most malls (IME) have a limit on what types of stores can duplicate. If nothing else, the mall should have some minor leverage in saying that they can not claim to be you.

^^^THIS^^^ Your lease should have had language preventing competitors. Unless it is very large.

If that other store is answering the phone claiming to be you then that is out right Fraud and a criminal act. Either way I'll call a lawyer ASAP and threaten to sue the man.

Not much you can do if someone moves in to your old store front. If I understand the OP correctly the PC shop claims to be or employ the other store. That is Fraud. Claiming something that doesn't exist. If they accept merchandize under that falsehood then it could be considered theft.

spoke to an attorney, they will send a decease letter to them

i technically can SUE them but i need to prove damages, since the customers found out and came to us there are technically no damages

the customers that never found out obviously had that store take care of them, thus i cannot prove THOSE damages

while i may not be awarded damages i may just sue them for $2000 and when they receive the summons they will bring their fraudulent carcass to my store and say we are sorry please dont sue us at which point i will make them the offer of 50% they pay me and i close the suit

its not even about the money or stealing customers its the fact that they CLAIM to be us, competition is competition

if they said no XMODDZ is horrible dont go there i would understand
but saying HI YES WE ARE XMODDZ is why i want to take any possible action against them

another funny thing is they dont even have a web site, how can a pc repair store NOT have a website
