Service Agreement
Note: * If a user-name and/or password is required in order to log-in, you must provide this on the service request form prior to servicing. If you do not, at our discretion, we’ll either refuse servicing or we’ll perform a password reset which will incur an additional cost.
1. PAYMENT TERMS.
Full payment for services rendered is due upon completion. Your PCMD, LLC accepts all major credit cards and cash. Checks are accepted only with a valid driver’s license and phone number. When ordering any non-stocked hardware, customer acknowledges that Your PCMD, LLC may require payment for parts before they are ordered. Customer acknowledges that the Diagnostic fee (if any) is nonrefundable and all sales are final.
2. SERVICE COMPLETION.
Upon service completion, client will be notified by telephone only. Client agrees to pay for services rendered within ten (10) days of service completion. Items cannot be pick-up until services are paid for. If items are not picked up within ten (10) days, a retroactive storage fee of $2 per day will be accessed along with the original invoice charges. After 30 days from the initial notification of completion of services, items will be considered abandoned and client thereby transfers ownership of items to Your PCMD, LLC for disposition.
3. WARRANTY.
If Your PCMD, LLC is unable to fix your issue or provide a solution, there will be no charge to the client. In some instances, parts may be required in order to resolve the customers issue. Those parts are covered under the manufacturer’s warranty. All hardware services include a thirty (30) day labor warranty from date of completion. 4. LIABILITY.
Your PCMD, LLC provides our services in an effort to repair, upgrade, or otherwise diagnose the computer for which you request such services. We will not intentionally harm your system. It is our goal to fix your computer. In the case of accidental damage or data loss to your system, further damage or data loss caused by already existing problems in your system such as malware, misconfiguration of software, or hardware problems/failures, you agree to hold us, Your PCMD, LLC, and any persons associated with or involved in the work being done for you, non-liable for any damages resulting from such problems. Your PCMD, LLC is not liable for any data loss. It is the client’s responsibility to back-up their computers data prior to service. Note: the manufacturer’s warranty may be voided with any service.
5. SERVICE AND SUPPORT.
Client satisfaction is of utmost importance to us. Your PCMD, LLC will back up its work with free support for the problems requested to be resolved from the service request form for a period of seven (7) days. Twenty-four (24) hours for malware removal. Additional support may be provided free of charge at our discretion.
6. INDEMNIFICATION.
Client agrees to indemnify and hold Your PCMD, LLC harmless from all claims, losses, expenses, and/or fees including attorney fees, costs, and judgments that may be asserted against Your PCMD, LLC or any persons associated with Your PCMD, LLC.
7. ENTIRE AGREEMENT.
This Agreement contains a partial agreement of the parties. Client should view and understand our entire terms of service located on our website at
www.yourpcmd.net/terms.php using either another computer, smart phone or tablet.
8. GOVERNING LAW.
This Agreement shall be construed in accordance with the laws of the State of Texas, County of Cooke, City of Gainesville.
9. PRIVACY POLICY.
Your PCMD, LLC respects the right to privacy of clients and takes steps to ensure that any information on the client’s computer will remain safe and secure. However, it is Your PCMD, LLC's legal responsibility to report any pirated software or illegal files witnessed during the repair to the appropriate authorities.
10. DONATIONS.
Customer agrees that the donation of any item immediately becomes the property of Your PCMD, LLC and cannot be given back or reversed.
