For anyone doing business in the US, and is wondering whether their liability clause in their terms and conditions would hold up in court, the linked pdf I think will help. The short document was written by a surveyor contractor, who is also a lawyer. I know the trade that he is in is different than IT, but there are some principles in the document that would apply regardless of the trade you're in. Obviously it's no substitute for consulting with a lawyer yourself, but it's an eye-opener, to say the least.
