How to deal with Dead Beats!

Looks like the SA laws are much easier to follow, and much friendlier for business.

Robert, thanks very much for this info. I actually rang OCBA last month with this question, as I had a customer who had not paid and was giving me the run around. The 'expert' on the phone assured me there was NO provision under SA law to sell repaired goods that havent been paid for. This link clears up that particular gem of misinformation. Much appreciated! :)

Just in case its of interest to anyone else:

What can you do if goods are left for repair or other treatment and the customer does not return to collect them?

If you have the customer's address or telephone number, you should contact and inform them that they have a month to collect the goods or they will be sold. Keep a copy of your letter or a note of your conversation for future reference. If you don't keep such records, place a conspicuous notice in your premises informing customers that uncollected goods may be sold six months from the date on which they would be ready.

You must tell a customer when their goods should be collected.

Selling uncollected goods

Before you sell uncollected goods, put a notice in a newspaper with State-wide circulation and keep a record of the date of publication. In the case of motor cars, the Registration and Licensing section of the Department of Transport must be notified of the intending sale.

You are entitled to keep a portion of the money from the sale to cover reasonable costs, such as storage of the goods, but must return the balance to the customer.
