Question Anyone willing share their Terms of Service?

Hello all. I am looking to draw up my TOS and I was wondering if any of you would be willing to share what you have. I do have the TN Business Kit and I think it's great but I would like to add several things and I would like to review what you guys (and girls) have. I will be more than willing to share my TOS once the document is completed. Thanks!

These have been checked with a lawyer (although UK based). Feel free to peruse and use what you want

Well, I started writing some notes that I would include in my web hosting and it will translate to other services as well. Please take these as a very rough draft but the basics are there.

Maybe you will find something within it that you will want to include in your TOS, maybe not. Either way feel free to use whatever you like from this. It's just ideas listed.

Web Services Terms of services contract
In this agreement Integrity Computing Solutions will be identified as ““COMPANY NAME”” and the customer agreeing to the terms of services will be identified as “you” or “customer”. These Terms of Service will here forth be identified as “TOS” throughout this document.

-”COMPANY NAME” can not be held liable for any loss of: data, content or revenue; due to corruption of data, downtime of servers, suspension of account for violation of TOS, deletion of data from servers or another methods of data loss.

-The customer is required to maintain up to date backups of all data with provided accounts and these accounts may be suspended due to a violation of the TOS. Once suspension of account has been initiated these accounts will not be reinstated until the dispute has been satisfied to the TOS agreement.

-If there is a violation of the TOS agreement and a suspension of services occurs there may be a “violation of contract” fee which will be automatically added to the standing account balance and must be paid in order for services to be restored. Failure to initiate recovery of services within 30 days of account suspension will move account suspension into account removal procedure in which accounts may be sent to collections and assets such as domain names and content, if owned by ICS, may be put up for auction in order to recover owed fees. “COMPANY NAME” reserves the rights to liquidate assets for any second level TOS violation.

-Second level TOS violations include promise to make payment with no payment being received within promised time in addition to payments made by check with inadequate funds.

-If payments made by check return to “COMPANY NAME” with inadequate funds, a mandatory fee of $35 will be added to the customers account balance in addition to an immediate suspension of account services.

-Should a violation of TOS occur and account suspension take place the customer may be charged a $30 administrative fee for suspension of account and re-activation of account upon settlement of violation.

-A violation of the TOS agreement may invoke the suspension of services which may include one or all of the following: suspension of web site, suspension of email accounts, placing an “account suspended” page on website, a $30 administrative fee, removal from “COMPANY NAME” links page of “Premium clients” lists,

-A second level TOS agreement may void standing contract of services which may include contracted prices. Upon reactivation of account the customer may be responsible to agree to updated contract prices and new contract agreement.

-Web hosting and email may not be used for sending any unsolicited emails (also known as SPAM). If a customer is found to be using their account for these activites they will immediately be eligible for a second level TOS violation.

-”COMPANY NAME” reserves the right to limit incoming or outgoing email at any time. If at any time the customer reaches this limitation, “COMPANY NAME” mat, at our discretion, adjust the customers limit at the customers request.

Payment for services is due at the beginning of service for the contracted billing cycle. “COMPANY NAME” reserves the right to terminate the account, without refund or notice, for violation of TOS.

-The customer is soley responsible for the development, operation and maintenance of the customers website.

-The customer may not publish a website which breaks any laws of liable, slander or of malicious content all of which is soley determined by “COMPANY NAME”. If the customer breaks this clause it will be considered a second level TOS agreement violation and restoration will only be considered upon removal of such violations on the site.

The terms are the same for drop-offs, my duplicate form they sign in-person or accept online for remote services right before being taken to the remote session (I also have an optional interrupt page for taking payment info, too).
