I dont know about the US, but in Australia:

No Peer-to-Peer application is illegal in itself. However it can be used to used to obtain or distribute content in such a way that it may violate copyright laws in Australia, and hence becomes illegal.

Its the same way here in the usa, its not illegal to have, just illegal to use.

Its also a really good way to get spyware and viruses. One of the first things you look for on a badly infected computer is Limewire, and remove it.

Peer to Peer applications them selves are not illegal how ever that does not stop them from being used for illegal purposes. No one can be in trouble or arrested for running a legitimate copy of Limewire, an illegitimate copy would be a pirated copy of the pay version of Limewire. You can be sued or arrested if you are cuaght using Limewire to pirate different material.

Actually, thats not quite correct. Limewire Pro IS FREE and it is open source. However some groups charge you for the privilege of downloading it.

Last I had checked Limewire itself charged for it... but I don't use it or like it bittorrent is my choice.
